License Agreement

This License Agreement ("Agreement") governs your use of the OpticChart AI mobile application and software. By downloading, installing, or using the App, you agree to be bound by this Agreement.

1. Grant of License

OpticChart AI grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on your personal mobile devices
  • Use the App for personal, non-commercial purposes
  • Access the features and services provided by the App

2. Permitted Uses

You are permitted to:

  • Use the App on devices you own or control
  • Create one account per person
  • Use the App to analyze trading charts for personal trading decisions
  • Create and store custom analysis strategies
  • Access your analysis history from any device

3. Restrictions

You may NOT:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove or alter any copyright notices or proprietary markings
  • Use the App for commercial purposes without prior written consent
  • Share your account credentials with others
  • Use automated tools to access the App
  • Attempt to circumvent the credit system or subscription limits
  • Redistribute or resell the App or access to it
  • Use the App for any illegal or unauthorized purpose

4. Intellectual Property Rights

All intellectual property rights in the App, including but not limited to:

  • Source code and object code
  • Text, graphics, logos, and designs
  • AI algorithms and machine learning models
  • Technical analysis methodologies
  • Patents, trademarks, copyrights, and trade secrets

Are owned exclusively by OpticChart AI and are protected by international intellectual property laws. Nothing in this Agreement grants you any rights to the intellectual property of OpticChart AI except as expressly stated herein.

5. User Content

You retain ownership of any content you upload to the App, including:

  • Chart images you analyze
  • Custom strategies you create
  • Personal data you provide

By uploading content to the App, you grant OpticChart AI a worldwide, non-exclusive, royalty-free license to store, process, and use your content solely to provide the services and improve our AI algorithms. We will not sell or license your content to third parties.

6. Subscription and Credits

The credit system is licensed as follows:

  • Credits are non-transferable and non-refundable
  • Credits do not expire and remain available until used
  • Each valid analysis consumes one credit
  • Failed chart detection after 5 daily attempts costs 0.5 credits
  • Free credits reset daily, plan credits are provided monthly, and top-up credits are one-time purchases
  • We reserve the right to modify the credit system and pricing with notice

7. Open Source Components

The App incorporates open source software licensed under various open source licenses. The licenses for these open source components are available upon request. The App includes the following major open source libraries:

  • Flutter (BSD License)
  • firebase_core, firebase_auth, cloud_firestore (Apache License 2.0)
  • flutter_riverpod (MIT License)
  • google_fonts (Apache License 2.0)
  • lucide_icons (ISC License)
  • purchases_flutter (MIT License)
  • And other third-party libraries as listed in the App's dependencies

8. Term and Termination

This Agreement is effective until terminated. Your license will terminate automatically if you:

  • Violate any provision of this Agreement
  • Fail to pay subscription fees
  • Request termination of your account

Upon termination, you must cease all use of the App and delete all copies from your devices. We reserve the right to terminate your license at any time, with or without cause.

9. Updates and Modifications

OpticChart AI may update the App from time to time to add features, improve functionality, fix bugs, or address security issues. These updates may be automatically applied. By continuing to use the App, you agree to receive such updates.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

11. Limitation of Liability

IN NO EVENT SHALL OPTICCHART AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY, ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE THE APP.

12. Indemnification

You agree to indemnify, defend, and hold harmless OpticChart AI and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses arising from your use of the App or violation of this Agreement.

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of United States.

14. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

This Agreement constitutes the entire agreement between you and OpticChart AI regarding the App and supersedes all prior agreements, representations, or understandings.
