1. Acceptance of Terms

By downloading, installing, or using the OpticChart AI mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

OpticChart AI is an AI-powered technical analysis application that provides trading chart analysis for various financial instruments including cryptocurrencies and stocks. The App uses machine learning algorithms to analyze uploaded chart images and provide insights based on technical indicators and market patterns.

3. User Responsibilities

As a user of the App, you agree to:

  • Provide accurate and complete information when creating an account
  • Maintain the security of your account credentials
  • Use the App only for lawful purposes
  • Not attempt to reverse engineer, decompile, or disassemble the App
  • Not use automated means to access the App for any purpose
  • Not interfere with or disrupt the App or servers

4. Account Registration

To use certain features of the App, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Subscription and Payment Terms

OpticChart AI offers subscription plans with different credit tiers:

  • Free Plan: Daily free credits that reset each day
  • Starter Plan: 50 credits per month - $2.00
  • Advance Plan: 200 credits per month - $5.00
  • Whale Plan: 1000 credits per month - $10.00

One-time top-up credits are also available at $0.10 per credit.

Each analysis consumes 1 credit. Subscriptions are charged on a recurring monthly basis until cancelled. You may cancel your subscription at any time through the App or your device's app store settings. Refunds will not be provided for partial subscription periods.

6. Intellectual Property

The App, its content, features, and functionality are owned by OpticChart AI and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works based on the App without express written permission.

7. Credit System and Usage

To prevent abuse of the analysis service, the following credit usage rules apply:

  • Valid Analysis: Costs 1 credit per analysis
  • Failed Chart Detection: After 5 failed chart detection attempts per day, additional failed attempts will cost 0.5 credits
  • Daily Credits: Free users receive daily free credits that reset each day
  • Credit Types: Credits are categorized as free credits, plan credits (subscription), and top-up credits (one-time purchase)

8. Premium Features

Access to certain features requires an active subscription:

  • Analysis History: Full access to past analyses, including original chart images, search, and filtering, is available only to users with an active subscription plan
  • Custom Strategies: All users can create and use custom analysis strategies

THE APP AND THE ANALYSIS PROVIDED ARE FOR INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE FINANCIAL ADVICE. TRADING CARRIES SIGNIFICANT RISK, AND YOU SHOULD CONSULT WITH A QUALIFIED FINANCIAL ADVISOR BEFORE MAKING ANY INVESTMENT DECISIONS. OPTICCHART AI IS NOT RESPONSIBLE FOR ANY TRADING LOSSES INCURRED WHILE USING THE APP.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPTICCHART AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.

11. Termination

We reserve the right to terminate or suspend your account and access to the App at our sole discretion, without prior notice, for any reason, including but not limited to breach of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of United States.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the new Terms in the App and on our website. Your continued use of the App after such modifications constitutes your acceptance of the new Terms.
